NOWi Sensors – Privacy Policy

NOWi Sensors LLC (“NOWi Sensors,” “we,” “us,” “our”) takes your privacy seriously. This Privacy Policy explains what personal information we collect when you use our website at www.nowisensors.com (the “Site”), our web monitoring platform and web installation app (the “Web Apps”), and our hardware products and embedded firmware (the “Products”), and how we use, share, and protect that information. Capitalized terms used but not defined in this Privacy Policy have the meanings given in the NOWi Sensors Terms of Service.

By using the Site, Web Apps, or Products, you agree to this Privacy Policy. If you do not agree, please do not use them. This Privacy Policy is part of, and is incorporated by reference into, the NOWi Sensors Terms of Service.

1. Information We Collect

Account and contact information. When you register an Account or contact us, we collect information such as your name, email address, phone number, mailing address, company name (if applicable), and password (stored in encrypted form).

Billing and subscription information. For paid subscriptions, we collect billing information such as your billing address and subscription history. Payment card information is collected and stored by our payment processor; NOWi Sensors receives only a token and the last four digits of your card for reference.

Property and installation information. To configure your Products, you (or your installer) may provide information about the property where the Product is installed, including site address, plumbing or electrical configuration, panel specifications, water metering equipment, and installation notes.

Device and sensor data. NOWi Products transmit data about your water and electrical usage, including flow rates, consumption totals, leak alerts, device status, diagnostic information, firmware version, and timestamps. This is the data that powers the Web Apps, the reports, and the alerts you receive.

Technical and log information. When you use the Site or Web Apps, we automatically collect information such as IP addresses, browser type and version, operating system, device identifiers, referring URLs, pages viewed, and timestamps of access. Our Products transmit similar diagnostic information about themselves.

Communications. We retain a record of your communications with us, including support tickets, email correspondence, and feedback you submit.

Cookies and similar technologies. The Site and Web Apps use cookies, web beacons, and similar technologies for session management, security, preference storage, and analytics. You can disable cookies in your browser settings, but some features of the Services may not function properly without them.

2. How We Use Your Information

We use the information we collect to:


  • Provide, maintain, secure, and improve the Site, Web Apps, and Products; 

  • Operate the alerting, reporting, and analytics features of the Web Apps; 

  • Send notifications about your Account, Products, and usage; 

  • Process payments and manage subscriptions; 

  • Provide customer support and respond to your inquiries. 

  • Develop new features, products, and services, including through research, testing, and analytics; 

  • Detect, prevent, and respond to fraud, abuse, security incidents, and unauthorized access; 

  • Comply with legal obligations, court orders, and lawful requests from authorities; 

  • Communicate with you about updates, new features, and, where permitted, marketing offers; and 

  • Aggregate or anonymize data so that it no longer identifies you, and use such aggregated or anonymized data for any lawful purpose.


3. How We Share Your Information

We do not sell your personal information. We share information only in the limited circumstances described below.

With your consent. With your consent, we may share information with our partners — for example, if you enroll in a program offered by an energy company, water utility, insurance company, property management partner, or a demand-response or rebate program. In those cases, we may share information such as your enrollment status, device activation, and data or alerts generated


by your device. You may withdraw your consent at any time, although doing so may affect your ability to participate in the relevant program.

With service providers. We engage vendors, contractors, and technicians who help us host the Services, monitor our servers, process payments, deliver email, provide customer support, and perform other functions on our behalf. These service providers may access your information only to perform tasks for NOWi Sensors and are contractually required to keep it confidential and not to use it for any other purpose.

As part of business transitions. If NOWi Sensors is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will require the recipient to treat your information consistently with this Privacy Policy and applicable law.

For legal reasons. We may disclose your information if we believe in good faith that disclosure is required by law, regulation, legal process, or governmental request; necessary to enforce our agreements; or necessary to protect the rights, property, or safety of NOWi Sensors, our users, or the public.

Aggregated or anonymized data. We may publish or share aggregated or anonymized data that does not identify you — for example, regional water-usage trends, leak-incidence statistics, or benchmarks that help users understand their consumption relative to similar properties.

4. Data Retention

We retain personal information for as long as your Account is active or as needed to provide you the Services. We retain device data for the duration of your subscription and for a reasonable period thereafter to support service continuity, analytics, billing reconciliation, and legal compliance. We may retain limited information after account closure as needed to comply with legal obligations, enforce agreements, resolve disputes, and prevent fraud.

5. Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest where appropriate, access controls, and routine security review. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.

6. Your Choices and Rights

You have the following choices and rights regarding your personal information:

Access and correction. You may access and update your Account information at any time by logging into the Web Apps or by contacting us.

Deletion. You may request that we delete personal information we have collected about you, subject to legal exceptions (for example, where we are required to retain it).

Marketing opt-out. You may opt out of marketing emails at any time by clicking the “unsubscribe” link in any such email. Transactional and service messages (e.g., billing notices, leak alerts, security notifications) will continue.

Cookies. You can control cookies through your browser settings.

U.S. state privacy rights. Residents of certain U.S. states — including California, Colorado, Connecticut, Virginia, and others with comprehensive privacy laws — have additional rights under state law, which may include the right to know what personal information we collect, the right to request deletion, the right to correct inaccurate information, the right to data portability, the right to opt out of targeted advertising and the sale of personal information (NOWi Sensors does not sell personal information), and the right to non-discrimination for exercising these rights. EEA, UK, and Switzerland rights. Residents of the European Economic Area, the United Kingdom, and Switzerland have rights under the GDPR and equivalent laws, including the right to access, rectify, erase, restrict, or object to the processing of personal data, and the right to data portability. To exercise these rights, contact us at privacy@nowisensors.com. You also have the right to lodge a complaint with your local data protection authority.

7. Children's Privacy

The Services are not directed to children under the age of 16, and we do not knowingly collect personal information from children under 16. If we learn that we have collected personal information from a child under 16 without verified parental consent, we will delete it. 8. International Data Transfers

NOWi Sensors is based in the United States, and the information we collect is processed and stored in the United States and may be accessed by our service providers in other countries. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in a country whose data protection laws may differ from those of your country. Where required by law, we use appropriate safeguards (such as standard contractual clauses) for international transfers of personal data.

9. Third-Party Links and Services

The Site and Web Apps may contain links to third-party websites or integrations with third-party services (for example, smart-home platforms, utility partners, or analytics providers). This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies before providing them with your information.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The “Effective” date at the top of this policy reflects the date of the most recent version. If we make material changes, we will notify you by email to the address associated with your Account or by a prominent notice on the Site before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the updated policy.
